Tackling The Difficulties Of Construction Law Disputes

The construction industry involves many different players, each with their own roles and expectations. When something goes wrong during the course of a project, many potential legal claims may arise. Sorting through those claims and pursuing — or defending against — a claim requires extensive legal experience.

At the law firm of Stephen Kaplan, P.C., we have that experience. Our well-established practice in both real estate and property matters as well as business litigation gives us the skill set necessary to tackle construction law claims and mechanic liens

. Based in Dallas, Texas, we represent clients throughout the Metroplex area.

Our legal team represents claimants, owners, laborers, suppliers, contractors and subcontractors in a wide range of construction law disputes, including:

  • Breach of contract claims
  • Payment disputes
  • Lien claims and defenses
  • Change and delay orders
  • Defect claims

We approach every dispute with an unwavering focus on protecting clients’ interests. Whether that means pursuing litigation, negotiating a favorable agreement or considering other out-of-court resolutions, we will work with you to develop a strategy to fit your situation.

Construction Defect Claims

Construction defects and design flaws can result in water intrusion. This, in turn, leads to mold and structural damage. Improper tucking, leaking dormers or improper grading can create liability for construction companies, builders and subcontractors. Physical repairs are often expensive and may or may not be covered under an insurance policy. In some cases, subrogation may be necessary if a business owner’s or homeowner’s insurer seeks reimbursement from a construction company’s insurer or from the maker of the defective materials.

As your attorney, Stephen Kaplan will work with experts to determine how mold or property damage occurred and can establish and assert your interests if any insurance litigation arises in connection with your case.
